Terms of Service
These Service Terms and the TELUS Local Telephone Service Terms apply to your use of forborne Digital Exchange Access Service if you have not signed a written agreement for forborne Digital Exchange Access Service. Digital Exchange Access Service (“DEA Service”) is provided by TELUS Communications Company.

Service Description
Digital Exchange Access Service provides you with digital access between your premises and the public switched telephone network (“PSTN”) using a 1.544 Mbps DS-1 facility that is subdivided into 24 DS-0 channels at the TELUS serving central office.

Service Components
DEA Service consists of the following service components:
(a) “access facility” which provides you with a DS-1 digital local loop from your premises to the TELUS serving central office;
(b) “PSTN termination” which provides the connection between the access facility and the PSTN, including toll and toll-free service, subdivided into 24 DS-0 channels; and
(c) “network” which provides for your use of services, each network service requiring one DS-0 channel.

TELUS Responsibilities
DEA Service provides you with:
(a) one (1) telephone number on the TELUS switch on which DEA Service is terminated;
(b) bi-directional PSTN access;
(c) toll free calling for telephone calls placed to the PSTN within the Extended Area Service boundaries of the Exchange Area in which the telephone number in subparagraph (a), above, is terminated; and
(d) one (1) white pages directory listing for the telephone number in subparagraph (a), above.

Your Responsibilities
You are solely responsible for the installation, operation and maintenance of terminal equipment that you use with DEA Service.
Any facilities and equipment you connect to TELUS’ network must adhere to applicable Industry Canada standards and applicable information at http://about.telus.com/publicpolicy/guides.html.
You shall notify TELUS prior to any changes you initiate that affect the current relationship between the telephone number provided to you for DEA Service and the physical location of terminal equipment you use with DEA Service.
Unless expressly permitted by TELUS, you shall not resell DEA Service, or access to DEA Service, directly or indirectly to third parties. If TELUS permits such resale to or access by third parties, you shall be responsible for all such third party use or access and shall indemnify TELUS against all damages, costs and legal fees incurred by TELUS from any claim arising from third party use of or access to the DEA Services.

9-1-1 Calls
You acknowledge and agree that:
(a) in regard to a call to the emergency telephone number 9-1-1, use of DEA Service results in calling line identification being delivered to TELUS’ network;
(b) the use of calling line identification in association with DEA Service could result in calls originating from a location other than the location associated by TELUS with the calling line identification for that number;
(c) if, in dispatching emergency services in response to a call to 9-1-1, reliance is placed on information associated with the calling line identification received by TELUS’ network in conjunction with the call to 9-1-1, emergency services may not be routed to the location from which the call to 9-1-1 originated; and
(d) in regard to a call to 9-1-1, you or any person using DEA Service or any services used in conjunction with DEA Service is responsible to provide complete and accurate information relating to the actual location of the emergency situation to the emergency services call operator.
Without restricting any indemnities in the TELUS Local Telephone Service Terms, you are responsible and shall indemnify TELUS for, and save TELUS harmless from and against, all charges, losses, costs, liabilities and damages of any kind whatsoever related to emergency services being dispatched to a location other than the location from which the call to 9-1-1 originated as a result of
(a) any use by you of DEA Service that results in the location associated by TELUS with a calling line identification being a location other than the location from which the call to 9-1-1 originated; and
(b) the failure by you or any person using DEA Service or any services used in conjunction with DEA Service to respond, or provide complete or accurate information, to a 9-1-1 or emergency call operator requesting a response or information in order to properly dispatch emergency services.

Changes
If you relocate DEA Services to a new service address, you must pay any applicable installation and construction charges, and all other rates and charges for the DEA Services at the new service address.

Other Documents
You will sign any authorizations required by other companies in order for TELUS to provide the DEA Services.

TELUS Long Distance
If, in using DEA Service, you use TELUS long distance services and the long distance services are not subject to an agreement between you and TELUS, TELUS’ Long Distance Terms of Service available here and the message toll schedule (as amended) available here or on request shall apply and are incorporated by reference and form part of this Agreement, mutatis mutandis.
Unless you have arranged for individual call details for each DEA Service telephone number, long distance calls made from DEA Service using TELUS long distance services will be billed to the pilot telephone number associated with DEA Service.

Confidential Information
Despite any other provision in this Agreement, any unlisted telephone number from which a call is originated using DEA Service is provided on a call-by-call basis to customers who subscribe to the call management feature call display and to TELUS for call trace.
